Circus Man Killed
St. Clairsville
John Hart, 23, of Birmingham, Ala was killed, and Lewis Walton, 36, of Chattanooga, Tenn, was critically injured today when a circus wagon plunged over a 50-foot embankment four miles from here.  Walton is in Martins Ferry Hospital. The wagon was part of the Haag Brothers' circus which has played the last several days in eastern Ohio.

Nashville Tenn, A legal battle over the use of Haag Bros' Circus title started before Federal judge john J. Gore here yesterday. In a preliminary hearing Judge Gore ruled against a temporary injunction order and a notice of appeal was filed. The case will proceed to a final hearing when the appeal is completed.

Mighty Haag Shows, Inc. a Florida corporation headed by Mrs. Alice Haag, widow of Ernest Haag, founder of Mighty Haag Shows, and her son, Harry, and daughter, Mrs. Helen Haag Durrett, are the complainants. They are seeking to stop the use of the Haag name in the title of the new show under unfair competition laws. The new show was organized last winter by Roy and Henry Haag, nephews of the founder of the Mighty Haag Shows. The original Haag show has been on the road for more than 40 years.

Bill of complaint alleges that the Haag Bros' title is confusing and misleading to the public, also that the new show is being palmed off to the public as the original Haag show. Defendants Roy and Henry Haag deny these allegations. Roy Haag in open court agreed to eliminate the objectionable advertising slogan pending the final hearing

1937 - When Haag Bros Circus was at Plymouth Indiana, members of the show had a memorial service in Old oak Cemetery in memory of those members of the Haag family who are buried there. They are Joseph and Elizabeth Haag, grandparents of the Haag Bros.; Henry and Clara Haag, Parents of the Haag Bros.; Bertha Haag and Amelia Haag Shadel, aunts of the brothers, and Ernest Haag, an uncle, who was the founder of the Mighty Haag Shows. Hymns were played by the Haag Bros Band under the direction of S. W. Floyd, and there were personal tributes by Fred Crandall, equestrian director. Floral pieces were placed on graves. Among those present were Henry and Roy Haag, their wives and families. (Billboard 7-17-1937, pg38)

5-6-1938 - Billposters of the Haag Bros Circus were in Mount Pleasant posting bills for a performance of the circus Tuesday, May 10, and employees of the World Brothers Circus which exhibited in Mount Pleasant Thursday went before Justice of the Peace Clyde H. Lowe to charge the Haag employees with tearing down World shows advertising. The difficulty was settled by the Haag employees paying the costs.

Ray Marsh Brydon, who had the freak show between 14th and 15th on O street about three years ago, was severely clouted this week by an opposition circus crew in Bellaire, O. Brydon now has the Great Harris circus and the muscle men were with Haag Bros. circus.  Two outfits have been making it tough on each other, and the Haag boys caught Brydon in a phone booth.  Completely demolished the booth and severely bruised Brydon.

Two Slain During Circus Gun-Battle
Beattyville, Kentucky
State highway patrolmen investigated today a gun-battle at a circus here that left two men dead, six persons wounded and caused performers hurriedly to strike their big top and leave this little mountain town. The dead were Barlow Durbin and former Lee county Sheriff Charles Blount, both of Beattyville Kentucky.  The wounded were Deputy Sheriffs John Mays and Robert Allen, both of Beattyville, Lincoln Moore of Beattyville, William Walden and his son, Donald, 8 of Ida May Kentucky and an unidentified negro circus employee.  Allen informed Mayor Tommy Pryse the shooting started while deputies attempted to arrest Durbin on a charge of drunkenness.  Sheriff Herb McQuire said that witnesses told him Blount fired first and then my deputies started shooting.  The shooting occurred as hundreds of merry-makers strolled through the circus midway.

Ex-Sheriff Charles Blount, Barlow Durbin Killed Monday - Two Lee County Deputy Sheriffs Held at Richmond Charged With Murder - Six Others Wounded in Fight

Charles BLOUNT, Ex-sheriff and Tax Collector of Lee County, and Barlow DURBIN, owner of a beer saloon and cold drink stand on the Beattyville-Booneville Highway were mortally wounded on the show grounds of the Haag Brouthers Show in this city, Monday afternoon about 2:-5 p.m.  Link MOORE, Special Police Officer of the city, Robert ALLEN and John MAYS, deputy sheriffs under Herb McGUIRE, Sheriff; William WALDEN, an employee of Petroleum Exploration and a negro roustabout employee of the show were also wounded.  Mr. WALDEN's small son was grazed on the heel.

All of the wounded men were rushed to the Pattie A. Clay Hospital at Richmond except Mr. WALDEN who was taken to Winchester for treatment.  Mr. DURBIN died at Ravenna and his body was taken from the ambulance and returned to hishome here late Monday evening.  Mr. BLOUNT died at the Richmond Hospital at 9:50 o'clock p.m., Monday and his body was returned here to his home early Tuesday morning.  Mr. MOORE after receiving treatment and examination at Richmond was returned to his home Monday night where he is recovering.  He has a broken right arm and suffered considerable loss of blood, and was also wounded in the side.  Deputy sheriffs ALLEN and MAYS are both at the Richmond Hospital where they are recovering from their wounds.  Mr. WALDEN who was taken to Winchester is reported as having lost considerable blood from a wound received in the thigh and will be returned home within the next few days.  The negro employee of the show was wonded in one arm, but left with the circus.

Deputy Sheriffs Robert ALLEN and John MAYS were arrested Tuesday morning at the hospital on a warrant charging them with the murder of Mr. BLOUNT, and they are being held by the officers of Madison county on that charge.

The funeral services for Mr BLOUNT were conducted at the Beattyville Christian Church Wednesday afternoon at 2:00 o'clock by the Rev. Luther NEWNAM.  The body was taken from the church to Riverview Cemetery where Proctor Lodge 213, F. & A.M., took charge and held Masonic rites.  The great throng of people assembled cound not get into the church building and it was taxed with the largest crowd ever assembled in the building in the recollection of church officials.  Masons attending the services were here from Madison, Wolfe, Estill and adjoining counties.

The funeral services for Mrs. DURBIN were conducted from his home in Proctor Wednesday afternoon at 3:00 o'clock by the Reverend W. L. MERRIN in the presence of a large crowd.  The burial services were concluded at the White Ash Cemetery where he was buried.

Mr. BLOUNT is survived by his widow and four daughters, Misses Virginia, Phyllis Jane, Betty June, and Mary Belle.  Mr. DURBIN is survived by his widow and two small children, Elizabeth Ann and Joseph Curtis.

Mighty Haag or Haag Bros?
David Thomas returned home Friday morning from a circus tour of the Southern states. He came to Zanesville from Thomasville, Ga, where the Mighty Haag circus closed for the season. Mr. Thomas was with the circus band.
